Reportable IncidentsThis channel is not for complaints or claims; such communications will be filed. It is designed to report particularly serious incidents that may involve the commission of a crime or a serious administrative violation, which the whistleblower firmly believes to be true. The events must have occurred within the professional or labor scope of our activity. Incidents unrelated to us should be reported to the competent police, administrative, or judicial authorities.
If a whistleblower knowingly provides false or misleading information, or makes a report to defame a person or entity, they will not be protected, and Fludet S.A. may take legal action against them. -
ProcessingFludet S.A. has appointed an internal information officer, who is the only person with access to the report and responsible for investigating it. Investigations are conducted with the utmost confidentiality. The reported party and others affected will not have access to the whistleblower’s identity.
If the whistleblower has provided contact information, they will be informed about the acceptance or rejection of their report and the final decision of the investigation. If a crime is confirmed, it will be reported to the Public Prosecutor or judicial authority. In cases of serious administrative violations, the competent authorities will be informed.
Regardless of using our internal channels, whistleblowers may also use external channels provided by the justice system or competent administrative authorities, either concurrently or alternatively. -
Whistleblower ProtectionAs long as the reported facts are not knowingly false or implausible, all people using our internal channels in good faith are entitled to protection. This includes the right to remain anonymous to the reported parties and others affected by the report.
Fludet S.A. guarantees that no whistleblower will face retaliation for reports submitted via internal channels, to the Independent Whistleblower Protection Authority (A.A.I.), or publicly disclosed under Law 2/2023. This protection extends to the whistleblower’s family, associates, and related entities.
Data processing under Law 2/2023 is lawful based on compliance with the legal obligation and public interest. In line with data protection legislation, all users are informed that their identity will be kept confidential and not disclosed to people mentioned in the reports or third parties, except in case of legal obligation.
Whistleblowers may exercise their rights of access, rectification, restriction, deletion, and portability of their personal data according to applicable law. Due to confidentiality, some rights may be subject to limitations, such as access or objection. Only designated personnel may access data in the Internal Information System, and communication to third parties is limited by law.
